Πρόκειται για την οδηγία 16 του 2007 του Συμβουλίου Υπουργών της Ε.Ε., η οποία δίνει τις γενικές κατευθύνσεις ως προς την πολιτική που πρέπει να ακολουθούν τα κράτη μέλη.
Ιδιαίτερη σημασία δινει η Ε.Ε. στο "user-generated content", στο περιεχόμενο δηλαδη που δημιουργείται από χρήστες του διαδικτύου, κι όχι σε αυτό που τους "σερβίρεται" έτοιμο.
Η Ε.Ε. εθαρρύνει δηλαδή τη συμμετοχή των πολιτών στη..
δημοκρατία των ΤΠΕ και δεν τους προορίζει το ρόλο του παθητικού δέκτη.
